Warriors Mark Kennels Guarantee and Sales Agreement

The following agreement is between Warriors Mark Kennels, hereafter referred to as “Breeder” and “PURCHASER” for the sale and purchase of one dog.

Use of the Dog:  It is agreed between breeder and purchaser that this dog is being acquired as a family companion dog or as a working dog to be used for tasks appropriate to its breed.

Registration:  The breeder certifies that the dog is eligible for registration under the Regulations of the appropriate registry, and will provide the proper forms for such a registration.

Health:  We offer puppies that we believe to be sound in mind and body, free from congenital defects and disease, and selectively bred to preserve true breed-type, ability, and temperament. The breeder warrants the dog to be in good health and does not appear to be clinically ill from parasitic infestation as of the time of sale. We do not guarantee the dog will be breedable at maturity. Further the breeder warrants that the dog is free of canine hip dysplasia and that the eyes are free from inherited eye disorders for a period of 3 years from date of purchase.

Breeder certifies that all information contained in this agreement is true and correct to the best of our knowledge and belief.

Breeder strongly encourages purchaser to have the dog seen by a Veterinarian of purchaser’s choice within 72 hours of picking up the dog. Said dog may be returned to the breeder for any reason within the 72 hours following purchase. Provided that the dog has not been damaged in any way.  The purchaser will then be entitled to a refund of the original purchase price.  If dog is returned for other than health reasons, refund is subject to resale of the dog and less the non-refundable deposit.  If your puppy becomes ill within 3 days from the day you receive it, you must call us immediately. If the illness is related to our facilities, we will pay the vet costs at a Veterinarian of our choice within your area.

Replacement Policy:  In the event of emergence of any genetic disorder, which is sufficiently serious in the opinion of two qualified veterinarians, one of whom selected by the breeder, (we reserve the right to get a second opinion at our cost the second opinion being the only decisive factor and we may require the return of the dog in question), the breeder agrees to:

Upon proof of spaying, neutering or return of said dog, breeder will replace the dog with one of equivalent quality, with the same guarantee or pay the vet bills up to the purchase price of the dog or, at the breeder’s option, we will refund the original purchase price.

Ownership Responsibilities: The purchaser agrees to maintain the dog in a humane environment and to properly train, socialize and care for it. The dog will also be properly licensed and Inoculated against communicable diseases and parasites as recommended by a qualified veterinarian.

Right of Recovery/Placement: In the event that the purchaser is unable to keep the dog or to provide an appropriate home in accordance with this agreement, the purchaser agrees to notify the breeder if any such contingency arises and will not abandon the dog to a shelter or give the dog away without notifying the breeder.  If the dog is to be sold, the purchaser must give the breeder the right of first refusal.
